Welcome to My Tour Way. These Terms and Conditions (“Terms”) govern your access to and use of the My Tour Way website, mobile application, booking services and community features. By accessing or using My Tour Way, you agree to these Terms. If you do not agree with these Terms, please do not use our services.

1. About My Tour Way

My Tour Way is a travel platform that allows users to discover destinations, hotels, restaurants, tours, guides, transportation and other travel-related services. The platform may also provide community features that allow users to create profiles, publish content, interact with other users and communicate through the platform. Unless specifically stated otherwise, My Tour Way acts as a platform connecting users with third-party travel and service providers.

2. Account Registration

To use certain features, you may need to create an account. When creating an account, you agree to:

• Keep your login credentials secure
• Not impersonate another person
• Not create accounts for fraudulent or unauthorized purposes
• Notify us if you believe your account has been compromised

You are responsible for activities carried out through your account.

You agree to use My Tour Way responsibly and in accordance with applicable laws. You must not:

• Use the platform for fraudulent or illegal activities.
• Harass, threaten, bully, stalk, or abuse other users.
• Impersonate another person.
• Create fake or misleading accounts.
• Share another person's private information without permission.
• Attempt to gain unauthorized access to another account or our systems.
• Upload viruses, malicious software, or harmful code.
• Use bots, scraping tools, or automated systems to collect platform data without permission.
• Interfere with the operation or security of the platform
• Use the platform to scam, deceive, or financially exploit other users.
• Submit false or malicious reports against other users.

4. Bookings and Reservations

My Tour Way may provide booking services for hotels, restaurants, tours, transportation, guides, activities, and other travel-related services. Availability, prices, cancellation conditions, and other booking terms may vary depending on the service provider.

A booking is considered confirmed only after the applicable booking or payment confirmation has been successfully issued. You are responsible for reviewing the booking details before completing a reservation.

5. Third-Party Service Providers

Many services listed on My Tour Way may be provided by independent third-party businesses. The relevant service provider is responsible for delivering the booked service, including its quality, availability, facilities, schedules, safety requirements, and provider-specific terms.

My Tour Way does not guarantee the quality, accuracy, availability, or suitability of every third-party service. Where appropriate, we may assist users and service providers in resolving booking-related issues, but this does not make My Tour Way responsible for the provider's services.

6. Service Providers

Many services available through My Tour Way are provided by independent third parties. The service provider is responsible for delivering the booked service, including its quality, availability, facilities, safety requirements, schedules and applicable provider-specific terms. My Tour Way does not guarantee that every third-party service will meet your expectations.

7. Prices and Payments

Prices displayed on the platform may be provided by the relevant service provider and may change based on availability, dates, taxes, fees or other applicable conditions. You agree to provide accurate payment and billing information. Payments may be processed through third-party payment providers. Additional payment provider terms may apply.

8. Cancellation and Refunds

Cancellation and refund conditions may vary depending on the booking and service provider. Before completing a booking, you should carefully review the cancellation, refund, modification and no-show conditions displayed for that booking. Where a booking is eligible for a refund, the refund will be processed according to the applicable booking and refund policy. Please refer to our Refund Policy for further information.

9. Changes, Cancellations and Disruptions

A service provider may change or cancel a booking due to operational issues, weather, safety concerns, availability, government restrictions or other circumstances. Where applicable, My Tour Way may assist with communication between the customer and service provider. My Tour Way is not responsible for losses caused by circumstances beyond its reasonable control.

10. Community Features

My Tour Way provides community features that allow users to share content and interact with others. You agree not to use the community for:

• Harassment, bullying or threats
• Hate speech or discriminatory content
• Fraud, scams or misleading activities
• Spam or unauthorized advertising
• Impersonation
• Sharing illegal or harmful content
• Sharing another person's private information without permission
• Copyright or trademark infringement
• Malicious links, software or other harmful material
• Any activity that violates applicable law

We may remove content, restrict features, temporarily suspend accounts or permanently terminate accounts where appropriate.

11. User Content

You are responsible for the content you upload or publish on My Tour Way, including posts, photos, videos, reviews, comments, and other materials. You confirm that:

• You own the content or have permission to use it.
• Your content does not violate another person's rights.
• Your content complies with these Terms and applicable laws.

You retain ownership of your original content. By uploading content to My Tour Way, you grant us a non-exclusive, worldwide, royalty-free license to store, display, reproduce, distribute, and technically modify your content as reasonably necessary to operate, maintain, improve, and promote the platform.

12. Copyright and Intellectual Property

All platform elements provided by My Tour Way, including its branding, logos, design, software, text, graphics, layout and original materials, are protected by applicable intellectual property laws. You may not copy, reproduce, modify, distribute, sell or commercially exploit My Tour Way's intellectual property without prior written permission.

User-generated content remains the responsibility of the respective user. If you believe content on My Tour Way infringes your copyright, please contact us with details of the relevant content and your ownership or authorization.

13. Reviews and Ratings

Users may be able to submit reviews, ratings and feedback about services. Reviews should be based on genuine experiences and must not contain false, misleading, defamatory, abusive or discriminatory information. We may remove reviews that violate these Terms or applicable laws.

14. Reporting and Moderation

Users may report content, accounts, reviews, or other activity that they believe violates our Terms or community rules. We may review reports and take appropriate action, including:

• Removing or restricting content
• Limiting specific features
• Issuing warnings
• Temporarily suspending accounts
• Permanently terminating accounts

The action taken may depend on the seriousness and frequency of the violation. We may also use automated tools and human review where necessary to help detect spam, fraud, harmful content, or violations of our policies.

15. Account Suspension and Termination

We may suspend, restrict, or terminate an account if:

• You violate these Terms.
• You repeatedly violate community rules.
• You engage in fraudulent or harmful activity.
• Your activity creates a security or legal risk.
• We are required to do so by law.

Serious violations may result in immediate account termination. If your account is terminated, you may lose access to your account, community content, bookings, or other platform features, subject to applicable law and any applicable booking or refund rights.

16. My Tour Way's Rights

We may:

• Modify, update, or discontinue features.
• Change or improve the platform.
• Remove content that violates our policies.
• Restrict access to certain features.
• Suspend or terminate accounts where appropriate.
• Correct inaccurate information or remove misleading content.
• Take reasonable steps to protect the security and integrity of the platform.

We do not guarantee that every feature will always be available or error-free.

17. Third-Party Links and Services

My Tour Way may contain links, services or integrations provided by third parties. We do not control third-party websites or services and are not responsible for their content, availability, policies or practices. Your use of third-party services may be subject to separate terms and conditions.

18. Travel and Service Information

Information about destinations, hotels, restaurants, tours, activities, prices, schedules, facilities, and other travel services may be provided by third parties. Although we may take reasonable steps to maintain accurate information, My Tour Way does not guarantee that all information is always complete, accurate, current, or available. Users should confirm important travel and service details with the relevant provider where necessary.

19. Safety and User Interactions

Users are responsible for exercising reasonable care when interacting with other users or participating in travel activities. My Tour Way does not guarantee the identity, behavior, intentions, qualifications, or safety of other users or independent service providers. Users should use appropriate judgment and follow applicable safety instructions when using travel or community services.

19. Limitation of Liability

To the extent permitted by applicable law, My Tour Way will not be responsible for indirect, incidental, special or consequential losses arising from your use of the platform or third-party services. This includes circumstances such as travel delays, cancellations, provider failures, weather conditions, incorrect information supplied by users or providers, or events outside our reasonable control. Nothing in these Terms excludes liability that cannot legally be excluded under applicable law.

20. Force Majeure

My Tour Way will not be responsible for failure or delay caused by circumstances beyond reasonable control, including natural disasters, severe weather, pandemics, government restrictions, strikes, technical failures, transportation disruptions, war, civil unrest or other similar events.

21. Privacy

Your use of My Tour Way is also subject to our Privacy Policy, which explains how we collect, use, store, and protect your information. By using My Tour Way, you acknowledge that you have read our Privacy Policy

22. Changes to These Terms

We may update these Terms from time to time. When changes are made, the updated Terms will be published on this page with a revised “Last Updated” date. Your continued use of My Tour Way after changes become effective means you accept the updated Terms.

23. Governing Law

These Terms shall be interpreted in accordance with the applicable laws of Sri Lanka, unless otherwise required by applicable law.
